Playtime 2023 terms and conditions

Ok now for a moment of seriousness so Playtime can feel clear and supportive!

By signing up to participate in Playtime, you are agreeing to the following terms and conditions.

Description

Euphemia Russell will provide 3 silly sessions as part of ‘Playtime for recovering serious people’ and you agree to receive and actively participate in these services.

Payments, cancellation, terminations and refunds

  • $120 USD one-time payment or 2 x $60 USD payments

  • If you change your mind, refunds may only be provided within 3 days of first payment.

  • If you are no longer able to attend the sessions, no refunds will be issued, but you will still have access to the recorded materials.

  • Participation in Playtime may be terminated if a participant engages in any behavior that is disrespectful to anyone in the group. In such cases, no refunds will be given.

Participation

  • Participants must be over 18 years of age.

  • The experience is talk and movement based only. No nudity or touch is involved.

  • To get the most of the sessions, participants should create time and space to be present and actively engaged during our time together.

  • Participants will take responsibility for resourcing your own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from our relationship.

  • Playtime can inspire many different feelings and thoughts, however participants know that our experience does not involve medical diagnosis or treatment and does not substitute for therapy. It is each participant’s responsibility to seek appropriate support from a qualified professional if needed.

  • The knowledge, resources, and tools learned and received during Playtime sessions are for personal use rather than commercial distribution.

  • Participant’s will ensure that their behavior aligns with any group agreements that are negotiated at the start of the sessions.

Confidentiality

  • All discussions and information shared during the sessions are confidential and should not be disclosed outside of the group.

Liability

  • There are no guarantees of any kind about the services being provided.

  • Euphemia Russell will not be liable for any indirect, consequential, or special damages. Notwithstanding any damages that may be incurred by participation,

  • Euphemia Russell’s entire liability under these terms and conditions, and exclusive remedy, shall be limited to the amount actually paid by the participant for all services delivered through and including the end date.

  • The participants and Euphemia Russell will both take reasonable steps to avoid errors or omissions in the performance of their obligations under this agreement. To the extent permitted by law, neither shall be liable to the other for any indirect, consequential, incidental, punitive, or special damages arising out of any errors or omissions made in the course of the contractual relationship, except for damages arising from intentional misconduct or gross negligence.

  • This agreement will be treated as if it were executed and performed in the state of California, USA and will be governed by and interpreted according to the laws of California without regard to conflict of laws provisions. In addition, participants agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by the participant must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

These terms and conditions state the entire understanding between the participant and Euphemia Russell and replace any prior agreements, negotiations, and discussions, in any format.
